TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale, hereinafter the “T&Cs”, govern sales made on the affichely.com website.
Article 1 – Identity of the seller
The affichely.com website is operated by:

Hereinafter referred to as “SAS ARTEMIS” or “the Seller”.
Article 2 – Purpose and scope
These T&Cs set out the rights and obligations of SAS ARTEMIS and its customers in connection with the online sale of posters, in particular personalised posters made to order in France.
They apply to any order placed on affichely.com by a consumer acting for non-professional purposes.
Confirmation of an order implies unreserved acceptance of these T&Cs.
The customer may consult and save the T&Cs before placing an order.
Article 3 – Products
The essential characteristics of the products are presented on the corresponding pages of the website.
The photographs, simulations, previews and representations of the products are for illustrative purposes. Slight differences may exist between the on-screen display and the printed product, in particular regarding colours, brightness, framing or the rendering of the medium.
These differences do not constitute a defect where they do not affect the essential characteristics of the product and remain inherent to display and printing processes.
Article 4 – Personalisation of the products
The customer selects or submits the information necessary for the creation of the product, in particular:
- the texts;
- the first names;
- the dates;
- the photographs;
- the colours;
- the format;
- the layout options.
The customer is responsible for the accuracy of the information provided.
They must carefully check the spelling, the dates, the contact details, the framing of the photographs and the options chosen before confirming their order or any preview.
Save for an error attributable to SAS ARTEMIS, an error contained in the information confirmed by the customer does not constitute a lack of conformity.
Article 5 – Content submitted by the customer
The customer warrants that they hold all the rights and authorisations necessary in respect of the texts, photographs, images, illustrations, trademarks or logos submitted.
They warrant in particular that their use:
- does not infringe the copyright or trademarks of any third party;
- does not infringe image rights or privacy;
- is not unlawful, defamatory, hateful or discriminatory;
- does not breach public policy.
The customer authorises SAS ARTEMIS to reproduce and technically adapt these items solely in order to design, manufacture, inspect and deliver their order.
SAS ARTEMIS may refuse or cancel an order that manifestly contains unlawful content or content infringing the rights of a third party.
Article 6 – Image quality
The quality of the printed result depends directly on the quality of the items provided by the customer.
SAS ARTEMIS may not be held liable for any lack of sharpness, pixelation or reduced quality resulting from an image that is:
- low resolution;
- blurred;
- heavily compressed;
- poorly lit;
- already pixelated;
- excessively enlarged.
Where possible, SAS ARTEMIS may warn the customer of an obvious problem, without such a check constituting a systematic obligation.
Article 7 – Prices
The applicable prices are those displayed on the website at the time of the order.
Unless otherwise indicated, prices intended for consumers are stated in euros, inclusive of all taxes.
Delivery charges are indicated separately before the final confirmation of the order.
SAS ARTEMIS may change its prices at any time. A price change does not apply to orders already confirmed and paid for.
Article 8 – Orders
The customer selects the products, the personalisations and the options they want, then checks the contents of their basket.
Before proceeding to payment, they may check and correct the information in their order.
The order becomes firm after:
- confirmation of the basket;
- acceptance of these T&Cs;
- confirmation of the obligation to pay;
- effective confirmation of payment.
A confirmation is sent to the customer at the e-mail address provided.
SAS ARTEMIS may suspend or cancel an order in the event of:
- failure or refusal of payment;
- incomplete information;
- suspected fraud;
- unlawful content;
- technical impossibility of manufacturing the product;
- a previous unresolved dispute with the customer.
In the event of cancellation at the initiative of SAS ARTEMIS without fault on the part of the customer, the sums collected for the cancelled products are refunded.
Article 9 – Preview and proof approval
Depending on the product or the option chosen, a digital preview may be presented or sent to the customer.
Where approval of a preview is required, production only begins after the customer's agreement.
Approval constitutes acceptance of:
- the texts;
- the spelling;
- the dates;
- the framing;
- the general layout;
- the visible personalisation options.
A preview displayed on a screen cannot guarantee an absolute colour match with the printed product.
Article 10 – Payment
The price is payable in full when the order is placed, using the payment methods offered on the website.
The payment methods actually available are displayed at the time the order is placed.
Payments may be processed by secure payment providers. SAS ARTEMIS does not necessarily have access to the customer's full banking details.
In the event of refusal of payment, the order is not confirmed.
Article 11 – Manufacturing
Personalised posters are manufactured on the basis of the choices and content confirmed by the customer.
Manufacturing may begin shortly after payment or after approval of the preview where a preview is provided for.
Once production has started, no modification or cancellation can be guaranteed.
The products are manufactured in France.
Article 12 – Delivery
Orders are delivered to the address indicated by the customer.
The carriers offered may include Chronopost and Colissimo.
Orders are generally manufactured and shipped within an indicative period of 48 working hours after their full confirmation.
This period may be extended in the event of a modification request, an incomplete file, high activity, a technical problem, a large order, a public holiday or force majeure.
The stated period does not necessarily correspond to the transit time alone. The total time includes manufacturing, preparation and transit.
The applicable delivery date or period is indicated when the order is placed or in its confirmation.
Article 13 – Delivery delay
If the stated period is exceeded, the customer has the rights provided for by the French Consumer Code.
The customer may in particular give SAS ARTEMIS formal notice to carry out the delivery within a reasonable additional period.
Where delivery has still not taken place at the end of that period, they may terminate the contract under the conditions provided for by law, except where the delay results from a case of force majeure or from an act attributable to the customer.
Article 14 – Transfer of risk
Where the customer is a consumer, the risks of loss of or damage to the product are transferred to them at the time when they, or a third party designated by them other than the carrier proposed by SAS ARTEMIS, take physical possession of the product.
Article 15 – Receipt and damage
The customer is invited to check the condition of the parcel and the product upon receipt.
In the event of apparent damage, they must, as far as possible, refuse the parcel or record precise reservations with the carrier.
They must promptly inform SAS ARTEMIS at contact@affichely.com, providing:
- their order number;
- a description of the damage;
- photographs of the product;
- photographs of the parcel and its label.
These steps facilitate the exercise of remedies against the carrier and do not limit the consumer's legal guarantees.
Article 16 – Right of withdrawal
16.1 Personalised products
In accordance with Article L.221-28, 3° of the French Consumer Code, the right of withdrawal may not be exercised for goods made to the consumer's specifications or clearly personalised.
Posters created with the customer's own photographs, texts, first names, dates, colours, formats or choices may therefore not be returned on the basis of a mere change of mind.
This exclusion does not affect the customer's rights where the product is defective, damaged or not in conformity with the order.
16.2 Non-personalised products
Where a product sold on the website is not personalised and does not fall under any legal exception, the consumer has a period of fourteen days from receipt to exercise their right of withdrawal.
They must inform SAS ARTEMIS of their decision by an unambiguous statement sent to contact@affichely.com.
The product must be returned no later than fourteen days following notification of the withdrawal, to the following address:

The direct costs of return are borne by the customer, save for an error by SAS ARTEMIS or agreement to the contrary.
The product must be returned complete, properly protected and in a condition allowing it to be resold.
The refund of eligible sums is made in accordance with the time limits and procedures provided for by law.
Withdrawal form applicable only to eligible products

Article 17 – Legal guarantee of conformity
The consumer benefits from the legal guarantee of conformity under the conditions provided for by Articles L.217-3 et seq. of the French Consumer Code.
The product must correspond to the description, type, quantity and quality provided for in the order and present the qualities that a consumer may legitimately expect.
In the event of a lack of conformity, the consumer may request that the product be brought into conformity by repair or replacement, in accordance with the legal conditions and provided that the solution chosen is possible and does not entail a disproportionate cost.
Where the legal conditions are met, they may obtain a price reduction or the rescission of the sale.
The legal guarantee of conformity applies independently of any commercial guarantee.
Article 18 – Guarantee against hidden defects
The customer also benefits from the guarantee provided for by Articles 1641 to 1649 of the French Civil Code.
They may bring a claim where the product has a hidden defect that renders it unfit for its intended use, or that so impairs that use that they would not have purchased it, or would have paid a lower price for it, had they known of the defect.
Under the conditions provided for by law, the customer may choose between returning the product for a refund or keeping the product and receiving back part of the price.

In order to facilitate processing, the customer must state their order number and attach any relevant supporting documents.
Article 20 – Liability
SAS ARTEMIS is responsible for the proper performance of its obligations in accordance with the applicable rules.
Its liability may not, however, be incurred where the non-performance or improper performance results from:
- an error by the customer;
- inaccurate information provided by the customer;
- a file of insufficient quality;
- content submitted without the necessary rights;
- an unforeseeable and insurmountable act of a third party;
- an event of force majeure.
No provision of these T&Cs may exclude or reduce the consumer's legal rights.
Article 21 – Force majeure
SAS ARTEMIS may not be held liable for any delay or non-performance resulting from an event meeting the criteria of force majeure within the meaning of French law.
The following may in particular be concerned, depending on the circumstances: a natural disaster, a fire, a major breakdown, an interruption of networks, a strike external to the company, an administrative decision, an epidemic or an exceptional disruption of transport.
Article 22 – Personal data
The customer's personal data is processed in particular in order to:
- manage orders and payments;
- manufacture and personalise the products;
- organise deliveries;
- handle complaints;
- comply with accounting and legal obligations;
- ensure the security of the website;
- send commercial communications where the required legal basis exists.
The customer may consult the detailed information in the Privacy Policy published separately on the website.
They may exercise their rights by writing to contact@artemis-print.com.
Article 23 – Consumer mediation
In the event of a dispute, the customer must first send a written complaint to SAS ARTEMIS.
Where this step has not made it possible to resolve the dispute, the consumer may refer the matter free of charge to the consumer mediator to which SAS ARTEMIS is affiliated:

The request for mediation must comply with the mediator's admissibility conditions.
Article 24 – Governing law and disputes
These T&Cs are governed by French law.
In the absence of an amicable resolution or mediation, the consumer may refer the matter to the competent court in accordance with the applicable rules of procedure.
The consumer may in particular bring proceedings before the court of their place of residence under the conditions provided for by law.
Article 25 – Severability
If any provision of these T&Cs is declared void or unenforceable, the other provisions remain in force.
Article 26 – Amendment of the T&Cs
SAS ARTEMIS may amend these T&Cs at any time.
The T&Cs applicable to an order are those accepted by the customer at the time of its confirmation.
